The “American-style” class action, when combined with private rights, is an important tool of American regulatory policy. And just as American regulation has global reach, the global class action is not unfamiliar to U.S. courts. Yet, global U.S. class actions are facing ever-stronger headwinds. In addition to the recent retrenchment of class actions and international litigation generally, U.S. courts have raised additional barriers to global class actions in particular. This Article’s first goal, therefore, is to document these developments and their (...) consequences for regulation. Against this backdrop, this Article also reviews the options available to foreign lawmakers, foreign courts, foreign litigants and litigation funders, and foreign public enforcers. Foreign lawmakers may provide alternatives to global U.S. class actions; foreign courts and foreign litigants may explicitly or implicitly coordinate to approximate global class resolution; and foreign public enforcers may achieve the goals of global regulatory litigation while avoiding some of its legal impediments. Finally, this Article evaluates these various foreign responses from an institutional perspective, with special attention to the institutional incentives for lawmakers and law enforcers. (shrink)

Efforts from diverse disciplines, including evolutionary studies and biomechanical experiments, have yielded new insights into the genetic, signaling, and mechanical control of tooth formation and functions. Evidence from fossils and non‐model organisms has revealed that a common set of genes underlie tooth‐forming potential of epithelia, and changes in signaling environments subsequently result in specialized dentitions, maintenance of dental stem cells, and other phenotypic adaptations. In addition to chemical signaling, tissue forces generated through epithelial contraction, differential growth, and skeletal constraints act (...) in parallel to shape the tooth throughout development. Here recent advances in understanding dental development from these studies are reviewed and important gaps that can be filled through continued application of evolutionary and biomechanical approaches are discussed. This book is a qualitative, interpretive, phenomenological, and interdisciplinary, examination of food and food practices and their meanings in the modern world. Each chapter thematically focuses upon a particular food practice and on some key details of the examined practice, or on the practice’s social and cultural impact.

Although mind‐wandering research is rapidly progressing, stark disagreements are emerging about what the term “mind‐wandering” means. Four prominent views define mind‐wandering as (a) task‐unrelated thought, (b) stimulus‐independent thought, (c) unintentional thought, or (d) dynamically unguided thought. Although theorists claim to capture the ordinary understanding of mind‐wandering, no systematic studies have assessed these claims. Two large factorial studies present participants (N = 545) with vignettes that describe someone's thoughts and ask whether her mind was wandering, while systematically manipulating features relevant to (...) the four major accounts of mind‐wandering. Dynamics explains between four and 40 times more variance in participants' mind‐wandering judgments than other features. Our third study (N = 153) tests and supports a unique prediction of the dynamic framework—obsessive rumination contrasts with mind‐wandering. Our final study (N = 277) used vignettes that resemble mind‐wandering experiments. Dynamics had significant and large effects, while task‐unrelatedness was nonsignificant. These results strongly suggest that the central feature of mind‐wandering is its dynamics. (shrink)

L’article se propose de vérifier le caractère néoplatonicien de la métaphysique d’Ammonius, fils d’Hermias, dans le dialogue intitulé Ammonius de Zacharie de Mytilène. Jusqu’à présent la recherche a cru pouvoir conclure de ce texte que la pensée d’Ammonius se rapprochait à certains égards du christianisme. Plusieurs éléments dans l’ Ammonius prouvent pourtant sans équivoque que le chef d’école alexandrin est resté fidèle au néoplatonisme païen, et notamment à la distinction proclusienne entre l’éternité divine et la perpétuité du monde.

Le récit du siège et de la prise d'Amid, place-forte de Mésopotamie, en 502, constitue un exemple intéressant de la manière dont se transmet un récit historique de la tradition grecque au domaine syriaque et au-delà. Présent dans l'historiographie grecque (Évagre, Procope, Malalas, Théophane) comme un épisode de la brève période d'affrontement entre Perses et Romains dans les années 502–507, ce récit connaît un succès particulier dans les textes syriaques où il passe du domaine de l'histoire à celui de la (...) légende. Cet épisode apparaît dans l'Histoire d'Édesse de 506 du pseudo-Josué, dans l'Histoire ecclésiastique du pseudo-Zacharie et dans toutes les chronographies importantes: celle de Zuqnin, du pseudo-Denys, dans celle d'Édesse de 1234 et dans celle de Michel le Syrien. Il est par ailleurs mentionné dans toutes les petites chroniques, qui indiquent la date, la durée, le nombre de victimes du siège. La similitude entre la version de Procope et celle du pseudo-Zacharie a déjà été relevée mais n'a jamais fait l'objet d'une enquête qui permette d'élucider les liens qui les unissent et d'établir par quelle voie ce texte est passé du grec au syriaque où il a été retravaillé pour répondre à des besoins apologétiques. La chute de la ville aux mains des Perses est en effet présentée à partir de l'Histoire ecclésiastique du pseudo-Zacharie comme une punition pour les chrétiens infidèles, livrés au roi perse Kavadh à qui le Christ serait apparu et aurait donné la victoire. Le récit est dès lors utilisé pour exhorter les communautés chrétiennes à persévérer dans la foi « orthodoxe ». Cette version du siège est ensuite traduite de manière inattendue en arabe puis en géorgien, dans ce qui semble être le reste d'une chronique. (shrink)

PREFACEProf. Göran Sundholm of Leiden University inspired the group of Logic at Lille and Valparaíso to start a fundamental review of the dialogical conception of logic by linking it to constructive type logic. One of Sundholm's insights was that inference can be seen as involving an implicit interlocutor. This led to several investigations aimed at exploring the consequences of joining winning strategies to the proof-theoretical conception of meaning. The leading idea is, roughly, that while introduction rules lay down the conditions (...) under which a winning strategy for the Proponent may be built, the elimination rules lay down those elements of the Opponent's assertions that the Proponent has the right to use for building winning strategy. It is the pragmatic and ethical features of obligations and rights that naturally lead to the dialogical interpretation of natural deduction.During the Visiting Professorship of Prof. Sundholm at Lille in (2012) the group of Lille started delving into the ways of implementing Per Martin-Löf's Constructive Type Theory with the dialogical perspective. In particular, Aarne Ranta's (1988) paper, the first publication on the subject, was read and discussed during Sundholm’s seminar. The discussions strongly suggested that the game-theoretical conception of quantifiers as deploying interdependent moves provide a natural link between CTT and dialogical logic. This idea triggered several publications by the group of Lille in collaboration with Nicolas Clerbout and Juan Redmond at the University of Valparaíso, including the publication of the book (2015) by Clerbout / Rahman that provides a systematic development of this way of linking CTT and the dialogical conception of logic. However the Clerbout / Rahman book was written from the CTT perspective on dialogical logic, rather than the other way round. The present book should provide the perspective from the other side of the dialogue between the Dialogical Framework and Constructive Type Theory. The main idea of our present study is that Sundholm's (1997) notion of epistemic assumption is closely linked to the Copy-Cat Rule or Socratic Rule that distinguishes the dialogical framework from other game-theoretical approaches. One way to read the present book is as a further development of Sundholm’s extension of Austin's (1946, p. 171) remark on acts of assertion to inference. Indeed, Sundholm (2013, p. 17) gave the following forceful formulation: When I say therefore, I give others my authority for asserting the conclusion, given theirs for asserting the premisses.Per Martin-Löf, in recent lectures, have utilized the dialogical perspective on epistemic assumptions to get out of a certain circle that threatens the explanation of the notions of inference and demonstration. A demonstration may be explained as a chain of (immediate) inferences starting from no premisses. That an inference J1... Jn—————Jis valid means that the conclusion J can be made evident on the assumption that J1, …, Jn are known. The notion of epistemic assumption thus enters in the explanation of valid inference. We cannot, however, in this explanation understand 'known' in the sense of demonstrated, for then we are explaining the notion of inference in terms of demonstration, whereas demonstration has been explained in terms of inference. Martin-Löf suggests that we here understand 'known' in the sense of asserted, so that epistemic assumptions are judgements others have made, judgements for which others have taken the responsibility; that the inference is valid then means that, given that others have taken responsbility for the premisses, I can take responsibility for the conclusion:The circularity problem is this: if you define a demonstration to be a chain of immediate inferences, then you are defining demonstration in terms of inference. Now we are considering an immediate inference and we are trying to give a proper explanation of that; but, if that begins by saying: Assume that J1, …, Jn have been demonstrated – then you are clearly in trouble, because you are about to explain demonstration in terms of the notion of immediate inference, hence when you are giving an account of the notion of immediate inference, the notion of demonstration is not yet at your disposal. So, to say: Assume that J1, …, Jn have already been demonstrated, makes you accusable of trying to explain things in a circle. The solution to this circularity problem, it seems to me now, comes naturally out of this dialogical analysis. […]The solution is that the premisses here should not be assumed to be known in the qualified sense, that is, to be demonstrated, but we should simply assume that they have been asserted, which is to say that others have taken responsibility for them, and then the question for me is whether I can take responsibility for the conclusion. So, the assumption is merely that they have been asserted, not that they have been demonstrated. That seems to me to be the appropriate definition of epistemic assumption in Sundholm's sense. One of the main tenets of the present study is that the further move of relating the Socratic Rule rule with judgemental equality provides both a simpler and more direct way to implement the constructive type theoretical approach within the dialogical framework. Such a reconsideration of the Socratic Rule, roughly speaking, amounts to the following. 1.A move from P that brings-forward a play-object in order to defend an elementary proposition A can be challenged by O. 2.The answer to such a challenge, involves P bringing forward a definitional equality that expresses the fact that the play-object chosen by P copies the one O has chosen while positing A. For short, the equality expresses at the object-languaje level that the defence of P relies on the authority given to O to be able to produce the play-objects she brings forward. More generally, according to this view, a definitional equality established by P and brought forward while defending the proposition A, expresses the equality between a play-object (introduced by O) and the instruction for building a play-object deployed by O while affirming A. So it can be read as a computation rule that indicates how to compute O's instructions. Let us recall that from the strategic point of view, O's moves correspond to elimination rules of demonstrations. Thus, the dialogical rules that prescribe how to introduce a definitional equality – correspond – at the strategic level – to the definitional equality rules for CTT as applied to the selector-functions involved in the elimination rules. So, what we are doing here is extending the dialogical interpretation of Sundholm's epistemic assumption to the rules that set up the definitional equality of a type.The present work is structured in the following way:•In the Introduction we state the main tenets that guide our book•Chapter II contains a brief overview of Constructive Type Theory penned by Ansten Klev with exercises and their solutions. •Chapter III offers a novel presentation of the dialogical conception of logic. In fact, the first two sections of the chapter provide an overview of standard dialogical logic – including solved exercises, slightly adapted to the content of the present volume. In lieu of an abstract, here is a brief excerpt of the content:7 Franciscan Studies 62 (2004) THE FRANCISCAN INSTITUTE HONORS GIOVANNI MICCOLI On July 16, 2004 Professor Giovanni Miccoli, a respected scholar of medieval, Church and Franciscan history, received the Franciscan Institute Medal from St. Bonaventure University during its celebration of the Feast of St. Bonaventure. University president Sr. Margaret Carney, O.S.F., and Fr. Michael Cusato, O.F.M., director of The Franciscan Institute and dean of the School of Franciscan Studies, (...) presented the medal during an Academic Convocation at 7 p.m. in The Regina A. Quick Center for the Arts. A reception followed in the Dresser-Rand Atrium. During the Convocation, Giovanni Miccoli gave a presentation, “A Reading of the Christian Proposal of Francis According to His First Biographers,” continuing a longtime focus on the study of Francis of Assisi and his contributions to the Church. Professor Miccoli, who was born in Trieste, Italy, in 1933, studied in Pisa at the Scuola Normale Superiore and the Università, in Munich at the Monumenta Germaniae Historica, and London at the Warburg Institute. He has taught in Pisa, Venice and his native Trieste, where he is now a professor emeritus at the Università di Trieste. A historian of the Middle Ages and of the Roman Catholic Church, he has combined those loves to specialize first in the Gregorian Reformation, reforms undertaken within the Church under Pope Gregory VII at the end of the 11th century. Turning his eyes to more modern times, he is also an expert on the relationship between the Catholic Church and Fascism in Italy, including the questions related to Pius XII’s pontificate during World War II. His study of the Church in Italy during the Middle Ages led to a focus on Francis of Assisi and his impact on the Church, which led to his becoming one of foremost Franciscan scholars of modern times. Miccoli is particularly known for his contribution to 1974’s “La Storia Religiosa” (Religious History of Italy), which is the second volume of “Storia d’Italia” (History of Italy). In “La Storia Religiosa” he examined how Francis and his movement influenced the history and development of the Church in Italy. 8 GIOVANNI MICCOLI Since that time, he has published several major articles on Franciscan issues, largely drawing from early Franciscan documents and sources, which have been translated from Italian to English and published in Greyfriars Review, a publication of the Franciscan Institute. One essay, “Francis of Assisi’s Christian Proposal,” was published in Italian in 1983 and in Greyfriars Review in 1989; another, “A Christian Experience Between Gospel and Institution,” appeared in Italian in 1992 and in Greyfriars Review in 1997; while a third, “The Writings of Francis,” was published in Italian in 1997 and in Greyfriars Review in 2001. The Franciscan Institute established the medal in 1987 to honor scholars who have made outstanding contributions to Franciscan studies in the areas of philosophy, theology, history and spirituality. Trieste is a city at the crossroads of the Latin, Germanic and Slavic worlds. Although largely ignored nowadays, in the past it was the harbor of Austria and, more recently during the Cold War, the last city of Western Europe facing the communist world. According to a (once) venerable tradition, our knowledge of the external world is crucially dependent on divine favor: our ability to obtain knowledge of the world around us is made possible by God’s having so ordered things. I argue that this view, despite its unpopularity among con­temporary philosophers, is supported by a certain inference to the best explanation: namely, it provides an effective way of reconciling two widely held beliefs that, on the assumption of naturalism, appear incompatible: (1) that knowledge (...) is incompatible with the kind of luck present in Gettier sce­narios and (2) that arguments for external world skepticism can be effectively rebutted by “shifting” them in the style of G. This paper argues that the concept and role of ‘institutional racism’ in contemporary discussions of race should be reconsidered. It starts by distinguishing between ‘intrinsic institutional racism’, which holds that institutions are racist in virtue of their constitutive features, and ‘extrinsic institutional racism’, which holds that institutions are racist in virtue of their negative effects. It accepts intrinsic institutional racism, but argues that a ‘disparate impact’ conception of extrinsic conception faces a number of objections, the most serious being that it (...) has no plausible account of what it is that makes extrinsically racist institutions racist. It also argues that claims about the explanatory indispensability of institutional racism are overstated (individual racism is at least as important), critiques structural approaches to racial inequality, and suggests that there is reason to doubt whether institutional reform can provide us with all that morality may require in the racial domain. Teleological terms such as "function" and "design" appear frequently in the biological sciences. Examples of teleological claims include: A (biological) function of stotting by antelopes is to communicate to predators that they have been detected. Eagles' wings are (naturally) designed for soaring. Teleological notions were commonly associated with the pre-Darwinian view that the biological realm provides evidence of conscious design by a supernatural creator. Even after creationist viewpoints were rejected by most biologists there remained various grounds for concern about the (...) role of teleology in biology, including whether such terms are: 1. vitalistic (positing some special "life-force"); 2. requiring backwards causation (because future outcomes explain present traits); 3. incompatible with mechanistic explanation (because of 1 and 2); 4. mentalistic (attributing the action of mind where there is none); 5. empirically untestable (for all the above reasons). Opinions divide over whether Darwin's theory of evolution provides a means of eliminating teleology from biology, or whether it provides a naturalistic account of the role of teleological notions in the science. Many contemporary biologists and philosophers of biology believe that teleological notions are a distinctive and ineliminable feature of biological explanations but that it is possible to provide a naturalistic account of their role that avoids the concerns above. Terminological issues sometimes serve to obscure some widely-accepted distinctions. (shrink)

This article endeavors to identify the strongest versions of the two primary arguments against epistemic scientific realism: the historical argument—generally dubbed “the pessimistic meta-induction”—and the argument from underdetermination. It is shown that, contrary to the literature, both can be understood as historically informed but logically validmodus tollensarguments. After specifying the question relevant to underdetermination and showing why empirical equivalence is unnecessary, two types of competitors to contemporary scientific theories are identified, both of which are informed by science itself. With the (...) content and structure of the two nonrealist arguments clarified, novel relations between them are uncovered, revealing the severity of their collective threat against epistemic realism and its “no-miracles” argument. The final section proposes, however, that the realist’s axiological tenet “science seeks truth” is not blocked. An attempt is made to indicate the promise for a nonepistemic, purely axiological scientific realism—here dubbed “Socratic scientific realism.”. (shrink)

Objective—To determine the prevalence of, and attitudes towards, observed and personal research misconduct among newly appointed medical consultants. Design—Questionnaire study.Setting—Mersey region, United Kingdom.Participants—Medical consultants appointed between Jan 1995 and Jan 2000 in seven different hospital trusts (from lists provided by each hospital's personnel department). Main outcome measures—Reported observed misconduct, reported past personal misconduct and reported possible future misconduct.Results—One hundred and ninety-four replies were received (a response rate of 63.6%); 55.7% of respondents had observed some form of research misconduct; 5.7% of (...) respondents admitted to past personal misconduct; 18% of respondents were either willing to commit or unsure about possible future research misconduct. Only 17% of the respondents reported having received any training in research ethics. Anaesthetists reported a lower incidence of observed research misconduct (33.3%) than the rest of the respondents (61.5%) (p<0.05). Conclusion—There is a higher prevalence of observed and possible future misconduct among newly appointed consultants in the UK than in the comparable study of biomedical trainees in California. Although there is a need for more extensive studies, this survey suggests that there is a real and potential problem of research misconduct in the UK. (shrink)

Misophonia is a condition characterized by defensive motivational system emotional responding to repetitive and personally relevant sounds. Preliminary research suggests misophonia may be associated with a range of psychiatric disorders, including personality disorders. However, very little research has used clinician-rated psychometrically validated diagnostic interviews when assessing the relationship between misophonia and psychopathology. The purpose of this study was to extend the early research in this area by examining the relationship between symptoms of misophonia and psychiatric diagnoses in a sample of (...) community adults, using semi-structured diagnostic interviews. Results indicated higher misophonia symptoms were associated with more clinician-rated symptoms of personality disorders, but not other disorders. Anxiety partially mediated the relationship between personality disorder symptoms and misophonia. These results suggest misophonia may be associated with a range of psychiatric symptoms and highlight the role of anxiety in this poorly understood condition. (shrink)

It was proposed that the data from Monte Carlo statistical investigations be subjected to analysis of variance methods rather than the conventional techniques of tabling, graphing, and inspecting the data. Two examples in which analysis of variance methods were applied to published Monte Carlo studies were presented. It was suggested that balanced factorial designs should be used whenever possible in Monte Carlo studies so that analysis of variance methods would be directly applicable. Finally, three advantages of analysis of variance methods (...) over conventional techniques were described and analysis of variance methods were contrasted with a possible alternative analytical method, multiple regression analysis. This is Part 1 of a paper on fibred semantics and combination of logics. It aims to present a methodology for combining arbitrary logical systems L i , i ∈ I, to form a new system L I . The methodology `fibres' the semantics K i of L i into a semantics for L I , and `weaves' the proof theory (axiomatics) of L i into a proof system of L I . There are various ways of doing this, we (...) distinguish by different names such as `fibring', `dovetailing' etc, yielding different systems, denoted by L F I , L D I etc. Once the logics are `weaved', further `interaction' axioms can be geometrically motivated and added, and then systematically studied. The methodology is general and is applied to modal and intuitionistic logics as well as to general algebraic logics. We obtain general results on bulk, in the sense that we develop standard combining techniques and refinements which can be applied to any family of initial logics to obtain further combined logics. The main results of this paper is a construction for combining arbitrary, (possibly not normal) modal or intermediate logics, each complete for a class of (not necessarily frame) Kripke models. We show transfer of recursive axiomatisability, decidability and finite model property. Some results on combining logics (normal modal extensions of K) have recently been introduced by Kracht and Wolter, Goranko and Passy and by Fine and Schurz as well as a multitude of special combined systems existing in the literature of the past 20-30 years. Purpose. The research is devoted to the analysis of the urgent problem of the information society: the overload of a person with information and, as a result, the impossibility of adequate formation and development of the personality; as well as the problem of "digitization" of human existence and the formation of a new reality of dataism. Theoretical basis. A lot of modern scientific works are devoted to the analysis of the information society, its problems and features. The information society is (...) a logical continuation of the scientific and technological revolution, which led to the rapid growth of scientific knowledge and the technology development. In the 20th century, technologies have touched the sphere of knowledge and information, as a result of which the formation and development of the information society, or "knowledge society", takes place. Information becomes the main resource in it, and, one way or another, a person’s life is inextricably connected with the information space. With the information society formation, the problem of information search and processing becomes one of the most urgent. It turns out that despite the abundance and availability of information, it is very difficult to determine its relevance. A lot of effort is spent on developing information retrieval algorithms. Another problem is related to the person’s inability to process large amounts of data. This situation begins to influence not only the education process and professional activity, but also the formation of a person’s personality. A person is "lost" in the information space and gradually loses his/her "I". Algorithms for data analysis come to the rescue, but gradually, instead of giving a person material for thought, they begin to make decisions on their own, and therefore, live life instead of a person. With the advent of Big Data processing algorithms, a new ideological paradigm appears – dataism, which predicts the merger of a person with the general data flow. Originality. The authors make assumptions that the dataistic future is "natural". A lot of works, including in the framework of philosophy, are focused on the problem of "dissolving" a person in the information space and finding ways to overcome it. But, in our opinion, this process is a completely logical continuation of human evolution. Conclusions. Existence of a person as a data flow is not a problem and a threat, but a new dimension of his/her being, and, therefore, requires a careful study and formulation of the main principles of this form of existence. Background: Facial attractiveness influences our perceptions of others, with beautiful faces reaping societal rewards and anomalous faces encountering penalties. The purpose of this study was to determine associations of visual attention with bias and social dispositions toward people with facial anomalies. -/- Methods: Sixty subjects completed tests evaluating implicit bias, explicit bias, and social dispositions before viewing publicly available images of preoperative and postoperative patients with hemifacial microsomia. Eye-tracking was used to register visual fixations. -/- Results: Participants with higher implicit (...) bias scores fixated significantly less on the cheek and ear region preoperatively (P = 0.004). Participants with higher scores in empathic concern and perspective taking fixated more on the forehead and orbit preoperatively (P = 0.045) and nose and lips (P = 0.027) preoperativel. -/- Conclusions: Participants with higher levels of implicit bias spent less visual attention on anomalous facial anatomy, whereas participants with higher levels of empathic concern and perspective taking spent more visual attention on normal facial anatomy. Levels of bias and social dispositions such as empathy may predict layperson gaze patterns toward those with facial anomalies and provide insights to neural mechanisms underlying the "anomalous is bad" paradigm. Worship is a topic that is rarely considered by philosophers of religion. In a recent paper, Tim Bayne and Yujin Nagasawa challenge this trend by offering an analysis of worship and by considering some difficulties attendant on the claim that worship is obligatory. I argue that their case for there being these difficulties is insufficiently supported. I offer two reasons that a theist might provide for the claim that worship is obligatory: a divine command, and the demands of justice with (...) respect to God's redemption of humanity. I also challenge the soundness of some of the analogies they employ in their argument. (shrink)
